Have you sold your home as a short sale recently?

If you have you may be entitled to some Tax Relief. Here are 5 of the ten tips from the IRS page.

IRS Tax Tip 2011-44, March 3, 2011

If you are a homeowner whose mortgage debt is partly or entirely forgiven during tax years 2007 through 2012, you may be able to claim special tax relief and exclude the debt forgiven from your income.

Here are 10 facts the IRS wants you to know about Mortgage Debt Forgiveness.
1. Normally, debt forgiveness results in taxable income. However, under the Mortgage Forgiveness Debt Relief Act of 2007, you may be able to exclude up to $2 million of debt forgiven on your principal residence.
2. The limit is $1 million for a married person filing a separate return.
3. You may exclude debt reduced through mortgage restructuring, as well as mortgage debt forgiven in a foreclosure.
4. To qualify, the debt must have been used to buy, build or substantially improve your principal residence and be secured by that residence.
5. Refinanced debt proceeds used for the purpose of substantially improving your principal residence also qualify for the exclusion.

Short Sales in Broward County Florida

I thought this day would never come! I have had a listing since 2009, a short sale in Sunrise, Fl. Wonderful 3/2.5 bath townhouse with Garage. We have gone through 5 buyers, that’s right 5 different buyers!!! This particular loan is with Bank of America, and I am sure you are familar with how hard it is to work with this bank trying to get Short Sales approved.

Every negotiator we had been unresponsive, no phone calls, no return emails, nothing. Then they come back say you have 24 hours to respond to a task they assign. Are you kidding me?! I send you so many emails and voicemail and now you are going to rush me? Well long and behold you rush get to them and they turn around and take just as long as before. So what happens? You lose the buyer because of the length of time it takes. Again it also depends on the buyers agent, whether or not they took the time to explain how long the process can take.

Well back in April, another buyer comes along, buyers agent is great, has explained to the buyer what it takes to get this done. It still took 4 months, but we have gone through it together. Well on Friday, I got a call from BOA that this Short Sale is Approved! Yeah that’s right it’s finally approved! Now our closing date is at the end of this month, so stay tune for a post that says CLOSED!!!!

Should I use a Real Estate Broker?

Using a real estate broker is a very good idea. All the details involved in home buying, particularly the financial ones, can be confusing at best. A good real estate professional can guide you through the entire process and make the experience much easier.

A real estate broker will be well-acquainted with all the important things you’ll want to know about a neighborhood you may be considering…the quality of schools, the safety of the neighborhood, traffic volume, and more. He or she will help you figure the price range you can afford and search multiple listing services for homes you’ll want to see. With immediate access to homes as soon as they’re put on the market, the broker can save you hours of wasted driving-around time.

When it’s time to make an offer on a home, the broker can point out ways to structure your deal to save you money. The REALTOR can guide you through the paperwork, and be there to hold your hand and answer last-minute questions when you sign the final papers at closing. And you don’t have to pay the broker anything! The payment comes from the home seller – not from the buyer.

How do I find one?

What you should do first is ask any friends or family members if they know of any REALTORS that they can recommend to you. If not, do a google search like Looking for a REALTOR in Fort Lauderdale, or Looking for a REALTOR in Broward County. See what comes up. You will find several. Who does not qualify for a Short Sale?

In a previous post we discuss who would qualify for a short sale. In this one, we will go over who does not qualify for a short sale. If you fall under this category then know that if you go through the process of a short sale, you will be denied.

1. Homeowners who realize their home is worth less than what they paid, but they don’t want to make the payments anymore.

2. Homeowners who have money in the bank and assets that can be liquidated, and sufficient income.

3. Homeowners who have a second home in another state or same state.

4. Investors

If you do fall under any of these, then trying to short sale your home will not work. If you do not fall under these, contact a Short Sale Professional in Broward County, to list and sell your home.
