			<content:encoded><![CDATA[<p style="text-align: left;">Let me start by saying thank goodness I am not a <strong>short sale</strong>!! Let me explain how I got to this. As you have read over the past few days I have been fighting <strong>Lennar Homes</strong> over the land use here in<strong>Woodmont</strong>. Our community is having an emergency meeting tom night and the president of the association rang my doorbell and asked if in my Warranty Deed was there any mention of the <strong>golf course</strong>.</p>
<p><a href="http://browardcountyreview.com/wp-content/uploads/2009/12/short-sales.jpg"><img class="aligncenter size-medium wp-image-530" title="short-sales" src="http://browardcountyreview.com/wp-content/uploads/2009/12/short-sales-300x177.jpg" alt="" width="300" height="177" /></a></p>
<p>I told them I would look at my deed and bring it with me. So I pull out the folder I had from when I closed on my house close to 10 years ago, and before I was a <strong>REALTOR</strong>. Going through all those pages I couldn&#8217;t find my Warranty Deed nor my Title Insurance. So that got me into thinking of when I was suppose to get them. I thought it should have been in that package.</p>
<p>So now on the hunt to find these papers. I called the title company that I did my closing and come to find out that they are no longer in business. OK now where do I go. I wasn&#8217;t sure if I was suppose to call the mortgage company I am with now since I had refinanced two years after I bought the house to change the type of mortgage I got, but changed companies at the same time.</p>
<p>I told myself what the heck let me give it a chance. I called the first time and the number they gave me was a fax, I called a second time and spoke with someone else. Then we got to talking as to why I needed the number. The guy was able to email me the Title Insurance and told me that I can find the Warranty Deed info through them.</p>
<p>So now we are calling this company and trying to read the papers of the insurance was confusing because they were asking me for the OR number. He looked up the number and couldn&#8217;t find the <strong>Warranty Deed</strong>. My thoughts are, Are you kidding me, was it not recorded? Do I own my house? The man just told me to calm down, we will figure this out. I then told him about this being the REFI and not the actual purchase.</p>
<p>He checked another place and viola, there it was, it was on a whole other page. Now what I need to do is to take that number and page down to the Broward County Courthouse and get copies.</p>
<p>But can you imagine if I was a <strong>Short Sale </strong>how crazy this would be, not having the right papers here, the refi, different pages. Glad I was able to figure it out and now pick up the papers tom.</p>
<p>Have you bought your home recently? I suggest you check to see if you have your <strong>Warranty Deed</strong> and <strong>Title Insurance</strong>. I gets sent to you after you close your home. I think somehow mine was not sent. I might not be the first person who is going through this, but at least you know what I had to do to find it.</p>

So I have listed here a couple of them. This was a converstation back and forth with a potential <strong>Short Sale Seller</strong> who had some questions.</p>
<p>She is out of the city, up in <strong>Tampa</strong> and has a home here in <strong>Sunrise</strong>. So this is how it went.</p>
<p><strong>Question</strong>: If you can give me some direction on what needs to take place for a short sale to be approved, I would appreciate it.  Do I have to be late on the payments before they will short sale it or can I put it on the market now while it is still current?</p>
<p><strong>Answer</strong>: First question is, Do you own another property? We can list it now, but with a short sale you have to give your financial information to the bank. That means they will need a copy of your bank statements and your paystubs.</p>
<p>We need to write up a hardship letter, which means that you have to explain why you can no longer pay your mortgage. Basically you will explain you were relocated to another part of the state and you can no longer afford the home.</p>
<p>The whole process can take time. The one I just closed on was listed early in the year, I would say March, got a contract 2 weeks before the bank was going to foreclose on it in June.</p>
<p>We just closed on it 3 months later. So this will take patience. You will need to sign an <strong>Auth form</strong> which gives me the right to speak on your behalf with the bank. I will let them know that you have listed the house for sale as a short sale and that we are working to get it sold.</p>
<p>Once an offer comes in I send it with all the buyers info and at the same time your finances with the listing contract, bank statements, pay stubs and last 2 W2&#8217;s and the hardship letter.</p>
<p>I know that it seems like a lot of information, but once you sign the Auth form I take it from there. You dont have to give me that stuff now, but once the offer comes you need to be able to give it to me within a day or so. This way the faster you get it to me the faster I can send it to the bank.</p>

<p><strong>Question</strong>:  I am in the process of trying to purchase a house here now.  Will that help or hurt?</p>
<p><strong>Answer</strong>: You should be able to purchase now, but you might get hit with a 1099 later on for the difference in the amount in the short sale.</p>
<p>Say you owe $250 and we sell it for $150, you may get hit with a <strong>1099</strong> for the <strong>100,000</strong> difference that we were short. Now I am not sure if you will get it or not. Mainly the inverstors have been getting the 1099&#8217;s, but I would suggest you check with a <strong>Tax Attorney </strong>so know for sure.<br />

<p>Now here we are, 3 years later and they are stuck like a rock. We got an offer a couple of days prior to the foreclosure sale date back in June and I was able to put off the foreclosure while we worked on the offer.</p>
<p>Then of course the buyers back out as we got an approval, now put the home back on the market at the approved price of $145,000.  This was a 3 bedroom, 2.5 bath with a huge yard. Updated Kitchen and bathrooms.  I received about 10 calls in 1 day to see the home and got an offer the same night at the approved priced!</p>
<p>Sent over the new buyers offer to the bank and got the approval letter from them within the day&#8230; The buyers are set to close on Sept 18 and looks like they will close sooner!</p>
